Proposed changes to the Working with Children Check now open for consultation
The Office of the Children’s Guardian is inviting the community to have their say with the release of a discussion paper to support the review of legislation that underpins the Working with Children Check (WWCC).
More than 2 million people in NSW hold a WWCC clearance, with over half a million processed in the past year alone.
The review will ensure the Child Protection (Working with Children) Act 2012 continues to protect children and young people, while remaining clear, fair and effective, and may lead to changes in how key terms are defined, who may require a WWCC, and how decisions are made.
Acting Children’s Guardian, Rachael Ward encouraged individuals, organisations and community groups to contribute their feedback. Consultation will run until February 2026 on the Have Your Say website.
'The Working with Children Check is the first and most critical step in protecting children and young people in NSW. This Review is about making sure the law keeps pace with community expectations, is fair for applicants, and continues to place children’s safety at the centre,' Acting Children’s Guardian, Rachael Ward said.
A public discussion paper and supporting resources, including easy-to-read guides and translated materials are now available.
